Miami Beach Divorce Attorney

Divorces where the assets are a condominium, a rental stream and often something held abroad.

Miami Beach estates look different from mainland ones. The marital home is frequently a condominium with substantial assessments and insurance costs; income may come from short-term rentals, hospitality ventures or investments rather than employment; and a meaningful share of the assets may sit outside the United States.

That combination raises three practical problems: valuing a unit whose carrying costs are rising, documenting rental and business income that fluctuates by season, and reaching foreign accounts or property through disclosure. Florida requires full financial disclosure of assets wherever they are located, and non-disclosure has consequences for the spouse who tries it.

Residency also comes up here more than anywhere else. Whether a spouse has been a Florida resident for the six months preceding the filing, and whether Florida is the right forum at all, needs to be answered before a petition is filed.

Filing a Miami Beach divorce

  • Miami Beach cases are filed in Miami-Dade County, in the Eleventh Judicial Circuit, with family matters at the Lawson E. Thomas Courthouse Center in downtown Miami.
  • One spouse must have been a Florida resident for at least six months before filing.
  • Mandatory disclosure covers foreign as well as domestic assets and income.
  • Condominium property is divided as an asset, with assessments, insurance and reserve obligations weighed alongside market value.
  • Contested cases go to mediation before trial.
